Litigation

Appeals

Litigation in the Trial Courts often results in appeals to the State or Federal Appellate level Courts. Our representation of your interest does not stop at the Trial Court. We are able to pursue or defend appeals of all issues important to your claim or defense, whether the appeal is from a decision by an Administrative Tribunal, or a Trial Court. We have the experience needed to prepare the necessary pleadings and briefs and to argue your position at hearings before the Appellate Courts.

Insurance Defense

We are often called upon by insurance companies who want seasoned, cost effective litigators to represent their insureds' business or personal interests in litigation. We also have experience in litigating first party claims and coverage or priority disputes. In addition, we handle a variety of subrogation cases. We have long standing relationships with several insurance companies who appreciate our aggressive representation, the personal attention to their files and direct accountability of the assigned attorney that comes with a law firm our size. We are aware of the insurer's need to have counsel that can manage the litigated file in accordance with defined litigation guidelines, without compromising the insured's interest in defense of the claim. Consumer Rights

Any person who suffers a loss as a result of unfair, unconscionable, or deceptive trade practices may have a cause of action under the Michigan Consumer Protection Act. There are more than thirty (30) types of conduct prohibited by the Michigan Consumer Protection Act, which provides for damages of Two Hundred Fifty Dollars ($250.00) or the actual damage suffered, whichever is greater, if a violation is found. In addition to damages, the violator may be held responsible for the consumer's attorney fees. Our firm can assist in the prosecution or defense of claims involving the Michigan Consumer Protection Act and other Consumer areas, such as claims under the Motor Vehicle Service and Repair Act, Magnuson-Moss Warranty Act, the Michigan Lemon Law, or the Homes Solicitation Sales Act.

Education Law

Public education involves a unique combination of issues with the potential for litigation. Constitutional rights, employees' concerns, the possibility of both accidental and intentional injury to students and staff, transportation issues and laws specifically addressing special education programs all co-exist, and on occasion result in the need to have Courts or other Tribunals resolve issues. The lawyers at Grua, Freeman, Tupper & Young have experience in representing school districts and colleges regarding these issues.
